TEMPO Indonesia fitnah Najib Razak lagi?

Laporan Jawatankuasa Kira Kira Wang Negara agak jelas walaupun disiapkan bersama pelbagai kekangan.

  1. The PAC Report on 1MDB
Many things have been said about the PAC report on 1MDB.
Chief among all are the statements made by Cabinet Ministers and UMNO stalwarts that the Prime Minister has been exonerated and absolved of all or any wrongdoing in 1MDB by the PAC. It is then concluded that The Prime Minister has been defamed all this while by the likes of WSJ, ABC, BBC, CNN. The Guardian, the Telegraph, Dr Mahathir, Muhyiddin Yasin, Shafie Afdal, Sarawak Report, Tony Pua, Rafizi Ramli, PKR, DAP and just about anybody and everybody in Malaysia.
To cap it all, Tan Seng Giaw, a DAP hotshot himself, appeared to have said that the Prime Minister was not “directly involved” in 1MDB. The Chief Secretary then followed to say that the Board of Advisors of 1MDB, of which the Prime Minister is the head, had never convened a meeting at all.
This I suppose put to rest any implication of wrongdoing by the Prime Minister by virtue of Article 117 of the memorandum and articles of association of 1MDB that required the explicit written endorsement of the premier for every single substantial transaction carried out.
The question then is: Did the PAC exonerate or absolve the Prime Minister of anything at all?
We need to see what this creature called the Public Account Committee is before we jump to any conclusion.
The PAC is a creature of the Parliament, being one of the Select Committees established pursuant to nothing less than the Standing Orders of the Dewan Rakyat. Rule 77 (1) of the Standing Orders expressly creates the PAC, whose functions, among others are to examine such accounts of public authorities and other bodies administering public funds as may be laid before the House and to prepare a report on such examination.
It is also given the power to “send for persons, papers and records, and to report from time to time”. Meaning it can summon and subpoena any person it deems necessary to appear before it for the purpose of such examination it is carrying out.
Standing Order 80A expressly gives the power to the Parliament to enquire into “any acts, matters or things as are made punishable as contempt under the Houses of Parliament (Privileges and Powers) Ordinance 1952, any acts or omission by any party.”
And in section 9 (a) of the aforesaid Ordinance, one of the act which constitutes contempt of the Parliament and is therefore punishable is “disobedience to any order for attendance or for production of papers, books, records, or documents made by the House or any committee duly authorized in that behalf, unless the attendance or production be excused as provided in section 19”. - Continued

Quite clearly, the PAC is equipped with the requisite powers to perform its functions and duties under the Standing Orders and the Constitution.
The PAC’s function are basically to examine and to prepare a report. That report is then presented to the Parliament. Adjunct to those functions, the PAC would of course, in its ordinary business, make recommendations based on its findings in its report.
It is not the function of the PAC to exonerate or absolved anybody. It is also not the function of the PAC to find anybody guilty of anything.
It may of course in its findings express its opinion on the guilt or culpability of any party or the exact opposite. It may in the former case of course recommend that any person be investigated by the authorities or be charged in Court. However, that remains a recommendation. It has no legal basis at all to base an argument that that person is guilty or culpable. Or otherwise.
Only a Court of Law would be able to do so.
If any person is charged in Court, I don’t even think that the PAC report could be tendered as evidence to prove that the accused person is guilty or otherwise. The PAC’s finding is not relevant in a Court of Law for the purpose of determining a person’s culpability, intention or innocence.
I had watched Tan Seng Giaw’s interview on Youtube. He did not at all absolve or exonerate the Prime Minister. He was just stating the obvious. He stated that the PAC, based on the evidence available to it, had found that the Prime Minister was not “directly involved” in 1MDB. Interpret it anyway you like.
However, if we read Tony Pua’s statements that certain documents relating to certain transactions were not given to the PAC despite requests and certain relevant witnesses were not called by the PAC, the PAC’s findings as such cannot be said to be conclusive at all. It can’t even be said that it was a sound finding.
    Tony was quoted as saying:
“"I would say this... Instead of saying PAC cleared the prime minister, the way to say it is PAC failed to clear the prime minister.
"This is because we were not given any documents to investigate, hence, we were unable to clear the prime minister even we if wanted to…”
He also was quoted as saying that the PAC was documents that were signed by the Prime Minister.
In light of what Tony and Tan Seng Giaw said, frankly I think the PAC report, rather then exonerating or absolving the Prime Minister, had succeeded only to cast further doubt over the propriety or even legality of certain transactions undertaken by it and whether the Prime Minister was complicit in such transactions.
In the face of all these things hovering above and around the PAC report, I will leave it to the readers whether to agree with the conclusion that the Prime Minister has been exonerated and absolved by the PAC. - ART HARUN

  4. Kem. Kewangan tak sedar surat Najib tamatkan KPMG
    Zikri Kamarulzaman
    10 Apr 2016, pagi 10:49

  5. Mystery of SRC International, millions transferred into Najib’s accounts

KUALA LUMPUR — Why did SRC International, a Finance Ministry-owned subsidiary, transfer millions of ringgit into the personal accounts of Malaysian Prime Minister Najib Razak, who is also the finance minister?

Did SRC International commit any criminal offence by transferring the funds into Mr Najib’s accounts?

Attorney-General Mohamed Apandi Ali said last month Mr Najib did not commit any criminal offence because he was unaware from where the money came.

But while the A-G has ordered the Malaysian Anti-Corruption Commission (MACC) to close investigations, several questions remain unanswered.

    WHAT IS SRC INTERNATIONAL?

SRC International was incorporated on Jan 7, 2011, and principally involved in projects associated with conventional and renewable energy resources, natural resources and minerals.

It is also involved in “any partnership, joint ventures or any arrangements for sharing profit, union of interest or cooperation and property holding”, according to its financial statement for the financial year-ending March 2012.

At the date of its incorporation, the board of directors comprised Mr Che Abdullah @ Rashidi Che Omar, Mr Suboh Md Yassin, Mr Paduka Ismee Ismail, Mr Nik Faisal Ariff Kamil, Mr Vincent Beng Huat Koh and Mr Shahrol Azral Ibrahim Halmi.

The identity of the current top management team is unknown, as Mr Faisal and Mr Suboh, both of whom served as the company directors, disappeared last year amid MACC’s investigations into the firm.

  6. Laporan Ketua Audit Negara masih dokumen OSA
    08 April 2016 1:33 AM

  8. Panel SPRM mahu debat Guan Eng- Rahman Dahlan dibatal: http://m.malaysiakini.com/news/337271

    - Dah agak dah. Last last mesti tak jadi punya. Sama macam skrip Dr. Maza/Ustaz Zamihan dan skrip Tony Pua/Arul Kanda dulu. Barulah gelabah biawak. Macam-macam alasan depa bagi. Ada kat oversea la, Speaker tak bagi la, SPRM tak bagi la, polis tak bagi la, out station la, tak terima surat jemputan la, kena lalu menteri dulu la, kena lalu KSU dulu la, surat jemputan tak ikut prosedur la, surat jemputan hendaklah dikeluarkan atas kapasiti orang perseorangan dan bukan penjawat awam la.
Kalau tak nak berdebat tu 1001 alasan dibaginya. Last sekali, macam biasa, debat tak jadi. Pastu pihak berkuasa masuk campur pohon debat dibatalkan. Hujung-hujungnya atau penamat dia mesti tak jadi. Kalau baru setahun jagung dalam poltik janganlah nak tunjuk terror. Kan dah terkena. Kan dah malu terpaksa chicken out.

  10. I see it this simple way.....PAC is like an OLD MAN without any tooth left to bite the STEAK that is so tender and perfectly grilled! We can take 2-3 weeks to openly debate the PAC`s Report pros & cons but at the end of the day there would be no enforcement, what a waste when first, Najib LIED, then asked for 6 months, then delayed further 3 months, along the way managing to purged, stopped, abolished, transfer, threatened, and all the `MAFIA` stuffs, but for nearly a year the deception as we saw it in the first place, sticked.

Let it go to COURT and we`ll see whether Najib can really shake-off the GUILTY stigma and not be send into 3-Walls with vertical iron bars enclosing it!

Sincerely hoped and pray and Doa, that however long it takes Najib and his accomplices will someday go into the slammer! Anwar Ibrahim is a case to ponder where all efforts to wriggle-out from your shit somehow drowned you!

  11. The PAC had left out Prime Minister Najib in its final report. He was barely mentioned. The carefully worded report absolved him from any wrongdoings. Both PAC and AG were on the same wavelength that Najib was not culpable in this 1MDB debacle.
If you study the AG and PAC history in recent months, this was not unexpected. Both investigations were started on high note with great expectations. Then there were sudden glitches in the middle of it.
The first one was sacked midway into his job while the latter suddenly promoted into the cabinet. The new ones were personally handpicked and installed into the posts. A happy ending of both stories were ensured afterwards.
When you have so much power concentrated in the hands of a man, he could do pretty much anything. I mean anything. It is us who were rendered speechless and could only watched helplessly as the events unfolded. Malaysia is being turning upside down by this one man. State institutions, rule of law, separation of power, all went down to the drain. I don't know if there is any hope for Malaysia. No wonder a 92-year-old man leap from his resting laurels and ferociously fighting just to put the country where its belong. He is willing to risk it all including his life and safety just for the sake of it. I hope he's not alone.
